1. Contracting Parties and Scope of Application

The provider of mentalhealthGPT aidX AG, Bachtelstrasse 57, 8330 Pfäffikon ZH, Switzerland (hereinafter "aidX"). These Terms of Use apply to the use of mentalhealthGPT app) and aidx.ch (website). By registering or using the service, you accept these terms.

2. Scope of Work

mentalhealthGPT an AI-powered clinical copilot for Mental Health . The platform assists therapists, psychiatrists, and clinical staff with documentation, case analysis, and clinical decision support. mentalhealthGPT not a medical device, does not replace a medical diagnosis, and does not relieve users of their professional duty of care.

Recording, Transcription, and Consent: The service can record and transcribe sessions, including through the optional Zoom integration. The user (therapist) is solely responsible for obtaining the necessary consent from participants prior to any recording or transcription and for ensuring that such use complies with the laws applicable in the respective jurisdiction (in particular, data protection and professional conduct laws). Third-party integrations such as Zoom are additionally subject to their own terms of use and privacy policies.

3. Access permissions

Use of this service requires successful registration with a valid user account. You are responsible for the security of your login credentials and for all activities conducted under your account.

4. Subscriptions and Prices

4.1 Free Trial

30 days free, full access to all available features, one time per account, no credit card required, no automatic subscription.

4.2 Founding Member

Limited plan. CHF 111/month or CHF 1,111/year; lifetime fixed price for existing members.

4.3 Professional

CHF 189 per month or CHF 1,990 per year. For individuals (up to 3 devices).

4.4 Institution / Clinic

Seat-based Custom Pricing a separate quote. Terms are negotiated on a case-by-case basis.

5. Payment Processing

Payment processing is handled by Stripe, Inc. (stripe.com), a PCI DSS Level 1-certified payment service provider. Stripe Tax automatically calculates the applicable taxes (VAT, EU VAT). The contracting party for your subscription is aidX AG Stripe does not act as the Merchant of Record.aidX AG does not have access to your full payment details.

6. Term and Termination

Subscriptions are billed monthly or annually and renew automatically unless canceled in advance. You can cancel at any time by going to Settings → Plan → "Manage Subscription" in the payment service provider's customer portal. After cancellation, access remains active until the end of the paid period.

7. Right of Withdrawal (EU Consumers)

Consumers residing in the EU generally have a 14-day right of withdrawal from the date the contract is concluded. This right of withdrawal expires for digital content or services as soon as performance has begun with your express consent and you have acknowledged that you thereby lose your right of withdrawal (Art. 16(m) of Directive 2011/83/EU). You will be explicitly informed of this during the checkout process, and your consent will be obtained.

8. Limitation of Liability

mentalhealthGPT a support tool not a substitute for professional clinical assessment.aidX assumes no liability for clinical decisions made based on AI outputs.

To the extent permitted by law ,aidX’s liability is limited to the subscription fee paid in the relevant calendar month. This limitation does not apply in cases of willful misconduct, gross negligence, or injury to life, limb, or health.

9. Availability

aidX strives to maintain high availability but does not guarantee uninterrupted service. Significant changes to the Terms of Use will be announced via email with 30 days' notice.

10. Privacy Policy

The processing of personal data is carried out in accordance with our Privacy Policy, as well as the Swiss Data Protection Act (DSG) and the GDPR.

11. Governing Law and Jurisdiction

Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zurich, Switzerland, unless mandatory consumer protection provisions preclude this.

12. Changes to the Service

aidX may further develop or modify the features, content, or technical components of the service, provided that the core benefits of the service are preserved.
